Life and Times of Louise Arbour

There is much to be said about this woman who has been working on the side of justice since 1971. Critics are omnipresent, but in the case of Louise Arbour, the simplest of facts sing loudly of her praises. This once young girl attended a convent school, pushed herself through college and University of Montreal, only to embark on an extraordinary journey of justice. Louise Arbour is a Canadian who makes a difference as a UN Commissioner, as a judge for the Supreme Court, and through her role in the Kingston Penitentiary Inquiry.There was an incredible report by Louise Arbour in the 1990's that rocked the boats of so many. Through this period of her life, she was working as a judge for the Court of Appeal of Ontario. Arbour's Inquiry into the Prison for Women at the Kingston Penitentiary in Kingston, Ontario was a large and controversial move. There was an event at the prison on April 22, 1994 involving six female prisoners. They suffered abuse at the hands of management, the guards, and male inmates.They underwent illegal segregation, strip searches, and the list sadly goes on. Louise held media attention for really the first major time in her career over this, and was up against a surprising amount of criticism. Even some of the inmates, those that she was helping in the first place, felt â€Å"Arbour was too lenient with officials who violated prisoners' rights† (Driedger, 1996) SQ. Her report was extremely important in the changing of ways that female convicts are handled through the Correctional Service of Canada.Her demands were just and fair, and essentially led to the closure of the prison in 2008. Her report holds the Correctional Service of Canada to a much higher standard. Women have an equal voice on the inside now; they have rights. It was Secretary General Kofi Annan who named Arbour United Nations High Commissioner for Human Rights, which she graciously accepted in 2004. She had been working as chief prosecutor of war crimes for the Interna tional Criminal Tribunal for Rwanda and the former Yugoslav.While Louise Arbour's experience and knowledge was developed around the Canadian criminal justice system, her time in the United Nations had developed her knowledge and skill in international law (Louise Arbour (Cover Story), 2000) SUMM. Rwanda was on her list, and Louise managed the great victory of indictments due to genocide against former government ministers there (Louise Arbour (Cover Story), 2000) PARA. Meanwhile, Former Yugoslavian President Slobodan Milosevic was brought to trial at The Hague, thanks to Arbour, following his arrest for crimes against humanity.After a 5 year trial, justice was served when he died in his cell of natural causes in March 2006. While Louise was responsible for many convictions, investigations and preservations of human rights during her time serving the United Nations, and this is a case that stands out above the rest. There is still controversy over whether or not Louise fulfilled her position adequately during her roles in the U. N. However, a very important person took great notice of Arbour, and found her to be so successful that he bestowed upon her the chair on which she now sits; a judge for the Supreme Court of Canada.One of the Justices was finally retiring, and the opportunity for Arbour to take the seat was at hand. This would be Louise's final position until her retirement. It is well known that the Supreme Court of Canada handles important and usually high-profile cases, of things from administrative law to constitutional law, and everything in between. Sitting as Madame Justice on countless cases and making her rulings, casting her vote, Louise has made an impact on our country.It was the Right Honourable Beverley McLachlin (2004) who said it best: And then she plunged into her life as a member of this Court, with the energy and dedication that she brought to every faucet of her life. On the Court, she has been a vibrant, incisive, and inquisitive pr esence. She brought her extraordinary sense of humour to our deliberations, and unfailing moral commitments to our decisions. A court of nine judges is like the delicate movement of a clock and her departure will no doubt change the sound and rhythm of the Court. Louise has had her hand in many decisions, has written many articles, books, reports etc. She is an influential person; living testimony of the Rule of Law. Building her life on that very principle, others look to her for guidance, seek her counsel, and regard her words as truth. Through all of her works, especially those as Commissioner, Justice, and Judge, LouiseArbour has made an unforgettable impact who continues to make a difference. For generations African Americans have been disadvantaged in America and effects of these injustices have made a lasting impression. Education is one of the leading problems in the black community. Though there have many reforms in education over the years, racial injustices still exist because no attention in placed on how legislature affects people of color. I was raised in a middle-class family of educators. My entire life I’ve been told to â€Å"stay in school, get an education, and work hard so that you can beat the system. † Recognizing the structural forces in my life has helped me understand my place in society. Being able to â€Å"understand everyday life, not through personal circumstances but through the broader historical forces that structure and direct it† (Desmond and Emirbayer 43) has really had an impact on me. My father was born in 1968, the year we consider then end of the civil rights movement. He went to Luscher Elementary during the 70s and at that time the school was integrated. He had mostly White teachers and schoolmates. He received a quality education because of the resources given to whites were now available to blacks. He chose to attend St. Augustine High school. The Archdiocese of New Orleans constructed St. Augustine High School with funds solicited from Catholics of the Archdiocese through the Youth Progress Program. The Archdiocese of New Orleans placed the school under the patronage of St. Augustine of Hippo, a preeminent Christian and scholar of Africa, and a Father of the Church. This was appropriate since from its inception the school was designated for the education of young men from Black Catholic families of New Orleans. St. Augustine High School led the way in battling segregation in New Orleans. The successful legal challenges mounted by the school resulted in the de-segregation of the high school athletics in the state of Louisiana. The famed Marching 100 was the first African-American high school band to march in the Rex parade on Mardi Gras Day. My grandfather and father attended St. Augustine High School and through the education they received along with athletic scholarships and financial aide they both went on to attend Loyola University. My position in society was shaped by my economic position, which was an effect of my grandfather and father’s educations. My grandfather was able to attend college but this was not true for his parents. Depending upon a persons situation social welfare programs can either enforce progression or plateau disadvantages. I was able to attend Isidore Newman School and I lived in an integrated neighborhood where resources such as schools, hospitals, parks and grocery stores were better than those in other parts of New Orleans. My integrated neighborhood provided me with a good education. Blacks in poor neighborhoods are inhibited from achieving the same education as whites because of zoning legislation, transportation and lack of funds. My family was able to establish themselves financially because of social welfare programs such as war bonds, Pell grants, and the integration of schools. My grandfather was able to own their own home and provide for our family. He had a career as a school administrator they paid well. He provided opportunities for his children to attend college and for his wife. Desmond and Emirbayer argue that , â€Å"If we hope to drive racial domination from the gates of our schools we must continue the work of confronting whiteness in the curriculum† (346). I understand that as finding ways to end institutional racism and raising awareness of ideologies that will end prejudices. Until I attended Loyola I had a naive impression of racial awareness. Personally, I believe education is the key to combating racism. We must education our peers on our cultures. We must explain that â€Å"colorblindness† in society is not what’s best. Only by embracing and recognizing each other differences we will be able to break the social bubbles we live in. I’ve gained a stronger sense of racial awareness through this course. I have the ability to challenge and change other people’s ideologies and understand my own. I know because of my social position have scholarships, financial aide and the values of hard work and education instilled in me by my parents and grandparents. I’m also aware that many people are not able to gain that same access. Because of my racial awareness there is so much more I want to find out about the contributing factors that led to my family’s social position in New Orleans. Four New York Police Officers, all members of the elite Street Crimes Unit spotted him. At that time the officers thought he matched the description of the serial rapist in the area. The officers were in plain clothes and approached Mr. Diallo. The following events were not clear but after everything, Mr. Diallo’s body was found riddled with bullets, 19 of which were considered fatal. There were 41 shots recorded in all, all coming from the four officers, none from the victim. A year after Mr. Diallo was defenselessly gunned down by four police officers in the Bronx district of New York, the case went to trial. In February 25, 2000 (Peet) the four police officers, Sean Carroll, Richard Murphy, Edward McMellon, and Kenneth Boss were all found not guilty of the death of the 23-year old West African. This case was to become one of the most controversial cases documented of police brutality in New York at the end of the century. After the verdict the World Socialist Website described the case as the â€Å"most appalling expression of the effective denial of basic democratic rights to working class and poor people†. Unfortunately the Diallo case is not an isolated case in the United States. In fact, it is a common situation that prevails between law enforcers and the public. International human rights organizations have put police brutality in the United States at the top of their priority. It is considered one of the most serious and divisive human rights violation in the country (Human Rights Watch). Although the Diallo case received nationwide attention because of the shear heinousness of the killing, there were other equally similar disturbing occurrences in other States. Atlanta alone recorded at least 12 shootings in the year 2000 (Wright). One of which was the shooting and killing of 18-year old Corey Ward. He was wrongly profiled as a criminal just because he was a young black man with a brand new SUV. It is also alarming that the same officer who mistook and gunned down Mr. Ward was involved in four other similar situations in the past. In another incident, a middle-aged woman, diagnosed with mental illness, was shot inside her own apartment. Barbara Schneider was killed in her own home after neighbors called the police to report that she had her radio too loud and they were concerned about her behavior. The police broke down her door and found her with a paring knife. Three shots and she was dead (Howell). Who could forget the case of Rodney King in 1991? Mr. King was repeatedly beaten by several police officers in Los Angeles after allegedly failing to stop when he was flagged down for a traffic violation. The whole world witnessed by videotape this horrifying ordeal of Mr. King. The acquittal of all the officers involved in the case triggered a stream of riots all over the city in 1992. The Los Angeles courts were forced to open up the investigation once again and this time the jury came back with a verdict of guilt of two officers, while the two others were acquitted for the second time. In recent times, police brutality and the use of excessive force seem to have become more rampant. In 2007 alone, the internet was bombarded with over 2,000,000 documented videos in this subject, all happening in the United States.
